Terms of Service

These Terms of Service ("Terms") govern your use of the Hush mobile application (the "App") and any related services (collectively, the "Service") provided by Maple Elegance Marketing Inc., a Canadian federally incorporated corporation operating the Hush brand (hereafter "we", "us", "our").

By creating an account or installing the App, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and accept these Terms. The Service is not directed at children; see our Privacy Policy for details.

2. The Service

Hush helps you and the caregivers you invite to track care events for the children in your family. The Service includes:

  • Local on-device storage (encrypted).
  • Optional sync of encrypted data across your authorized devices and caregivers.
  • Optional subscription features ("Hush Premium").

We may add, change, or remove features at any time. We will give at least 30 days' notice for material reductions to a paid tier's feature set.

3. Your account

You sign in with a Google account via Google Sign-In. You are responsible for:

  • Keeping your Google account and device secure.
  • Safely storing your 24-word recovery phrase. Anyone who has your phrase can decrypt your family's data. If you lose every device and your phrase, your data cannot be recovered. This limitation is intrinsic to the end-to-end encryption design — there is no "forgot password" path that bypasses your phrase.

4. Subscriptions and payments

4.1 Plans

Hush offers:

  • A free tier with limited features and non-personalized ads.
  • Hush Premium Monthly at $4.99 / month, cancel anytime.
  • Hush Premium Yearly at $39.99 / year, with a 14-day free trial for new subscribers.
  • Hush Lifetime at $129 one-time.

All payments are processed by Google Play. We do not see your payment-method details.

4.2 Auto-renew

Monthly and Yearly subscriptions auto-renew through your Google Play account unless cancelled at least 24 hours before the end of the current period. You can cancel any time at Google Play → Subscriptions; the subscription remains active for the period you've already paid.

4.3 Free trial (Yearly only)

The 14-day free trial is available once per Google account, and only on the Yearly subscription. During the trial you have full Premium access. If you do not cancel before the trial ends, Google Play will charge you $39.99 and start the yearly renewal cycle. Cancel at any time before the trial ends and you will not be charged.

4.4 Refunds

Refunds are governed by Google Play's refund policy. We do not issue refunds directly. As a courtesy, we may forward unusual refund requests to Google on your behalf when contacted within 7 days of charge — email support@hush.app.

4.5 Lifetime

Hush Lifetime is a one-time purchase that grants you Premium for the operational lifetime of the Service. Lifetime purchases are non-refundable after 14 days from the purchase date, except where required by Google Play policy or local consumer law.

If we ever discontinue the Service, lifetime purchasers will receive at least 90 days' notice and a full encrypted backup export of their data.

4.6 Premium covers your family

A single Premium entitlement applies to every caregiver invited to the family vault owned by the purchaser. You do not need separate subscriptions for co-parents, grandparents, or nannies.

5. Acceptable use

You may not use the Service to:

  • Track data about other adults without their consent.
  • Share your account credentials publicly.
  • Reverse-engineer the Service to identify other users.
  • Commit unlawful acts.

We may terminate accounts that violate these Terms.

6. Your content

Your logged data ("Your Content") belongs to you. We claim no ownership.

By using the Service, you grant us a limited, non-exclusive license to store the encrypted ciphertext of Your Content on our servers and route encrypted blobs to your authorized devices and caregivers. We cannot decrypt Your Content. This license terminates when you delete your account or your data.

7. Disclaimers — not a medical device

Hush is an informational tracking tool. It is not a medical device, and the events you log are not clinical data. Age-based content cards, growth notes, symptom logs, and pediatrician-prep PDFs are informational only. Always consult your pediatrician for medical decisions about your child.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HUSH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $50.

Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold Hush harmless from any claim arising from your violation of these Terms or your misuse of the Service.

10. Termination

You may terminate at any time via:

  • Settings → "Sign out and wipe device" to wipe the local install.
  • Settings → "Delete family vault" to also remove the server-side ciphertext.
  • Google Play → Subscriptions to cancel any active subscription.

We may suspend or terminate accounts that violate these Terms, with notice when reasonably possible. Upon termination, your encrypted blobs are deleted from our servers within 30 days. Subscription periods already paid are not refunded except as required by Google Play's refund policy.

11. Changes to these Terms

We will notify you in-app at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-laws principles. Disputes will be resolved by binding individual arbitration under the rules of the ADR Institute of Canada. You waive the right to participate in a class action. If arbitration is unavailable in your jurisdiction, disputes will be resolved in the courts of Alberta.
